10 Steps to Becoming a Statutory Guardian of Property with TBH admin

The quick version:
  1. Watch the video “Adult Guardianship Explained” and Pre-Qualify using the quiz
  2. Be mindful of the fees that ARE required and that MAY be required – See fees
  3. Contact TBH admin by filling out the contact form “I’m Ready to Get Started
  4. Fill out the forms required to become a TBH admin client (sent to you in an email)
  5. Do your TBH admin “Homework” which will be provided to you in 2 parts (sent to you by email)
  6. Pick your Capacity Assessor and ensure your loved one attends the capacity assessment (TBH admin will provide a detailed list of Ontario Capacity Assessment Office trained Capacity Assessors, which will include their fees charged, availability, locations served, etc.)
  7. TBH admin will complete the application process (ie: forms, management plan, etc.)
  8. The applicant (you) must physically sign the paperwork. (documents will be mailed/couriered to the applicant(s) for signature(s), if in-person signature(s) are not possible)
  9. TBH admin will ship the completed application package to the Office of the Public Guardian and Trustee (PGT)
  10. Application approval times vary from 3 weeks to 6 months+ depending on the complexity of the application. On average, TBH admin approvals are granted within 6-8 weeks after submitting the application.

Statutory Guardianship of Property Fees

(REQUIRED FEES AND POSSIBLE FEES) TO BE AWARE OF
  1. TBH admin Guardianship of Property Application Service Fee(s) 2026 Pricing:
    • $1,500 *TBH admin FEE for an adult child with a disability since birth.
    • $2,500 *TBH admin FEE for an incapable adult who became incapable later in life due to an accident or illness.


      *TBH admin FEES include the following:

      • HST
      • Application/Form Filling Service
      • all mailing/shipping fees up to and including the 1st revision after the application package has been submitted
      • scanning and/or photocopy expenses
      • One (1) time “Revision” to the initial application package that is requested/required by the Office of the Public Guardian and Trustee (PGT) BEFORE client(s) is/are approved as Guardian(s).
        Any “Revisions requested/required by the PGT AFTER the “first revision request” will be the responsibility of the client(s) to complete and completed at the client’s expense (not TBH admin).

      The “TBH admin FEE” is to be paid to TBH admin at the beginning of the application process, after the contract is signed between TBH admin and the client(s).
      A receipt will immediately be provided for the payment. NOTE: The Guardianship of Property Application Service will not commence without first providing payment in full to TBH admin.

  2. Capacity Assessment fee will range from $800.00 – $3,500.00 depending on the capacity assessor chosen by you. The fee is discussed between you and the capacity assessor you have chosen, paid directly to the capacity assessor, and is due when the capacity assessor advises it is due.
    • NOTE 1: To apply to have your capacity fee “covered” due to low income, you must contact the Capacity Assessment Office. Please be prepared to disclose your annual family household income in order to be considered.
    • NOTE 2: It is also possible that the applicant’s employment benefit package may have coverage (full or partial) towards capacity assessments. Guardianship applicant must inquire on their own, to their benefit supplier. TBH admin will not contact third parties on your behalf.
  3. If / when the guardianship has been approved, the PGT may ask for a filing fee of $431.66 ($382.00 plus HST $49.66). There is an opportunity to ask for this fee to be waived if this fee would cause the incapable person undue hardship. This fee will be collected from the incapable person’s property, or if insufficient funds are held by the PGT, will be payable by the applicant prior to issuance of the certificate of statutory guardianship. This fee is not due to the PGT until after the application is approved.
  4. A “surety bond” is like “insurance” or protection to the incapable person’s property. The premiums are paid from the incapable person’s funds. You will be notified when your application is approved whether or not a surety bond is required as it may depend on the assets. As a general rule, the PGT will require a surety bond if the incapable adult’s assets are $250,000 or more, or $500,000 including real estate, and the applicant is the spouse, partner or parent of the incapable adult. For all other applicants, if the incapable adult has assets worth $100,000 or more. If the PGT advises that a surety bond is required, you will be sent a list of surety providers which are private insurance companies, (not government agencies) to contact.
    • NOTE: If the applicant resides outside of Ontario, Canada, they will be asked to provide a bond regardless of the value of the incapable person’s assets.
